1. Agreement to Terms
By accessing or using Overbooked™ (the "Service"), a product of Ezier ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Subscription and Payments
2.1 Subscription Plans
We offer three subscription tiers:
- Free Plan: Limited to 1 team member, up to 3 active projects, and basic features
- Pro Monthly Plan ($9/month/member): Includes AI features, unlimited projects, team management, and advanced functionality
- Pro Yearly Plan ($90/year/member): Same as Pro Monthly plan, but billed annually with a 2 months discount.
2.2 Payment Terms
Subscription fees are billed in advance on a monthly basis. All payments are processed through Paddle. You agree to maintain valid payment information and authorize us to charge your payment method.
2.3 Refunds
You can cancel your subscription at any time, but refunds are not provided for partial months.
Once you cancel your subscription, your plan will be downgraded to Free Plan and you will lose all the Pro features after the current billing period.
3. User Responsibilities
3.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
3.2 Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Share account credentials with unauthorized users
- Attempt to bypass any Service limitations or security measures
- Upload malicious content or interfere with the Service's operation
- Exceed the usage limits of your subscription plan
4. Client Management
When using our Service to manage client relationships, you agree to:
- Obtain necessary permissions before adding client information
- Use client data only for legitimate business purposes
- Maintain confidentiality of client information
- Comply with applicable data protection regulations
5. Intellectual Property
Overbooked™ and related trademarks are owned by Ezier. The Service's content, features, and functionality are owned by Ezier and protected by international and Turkish copyright, trademark, and other intellectual property laws.
6. Data Storage and Backup
While we maintain regular backups of the Service using Convex infrastructure, you are responsible for maintaining your own backups of critical business data. We are not liable for any data loss or corruption.
7. Service Availability and Updates
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.
8. Third-Party Services
The Service integrates with third-party services including:
- Clerk for authentication
- Convex for backend services
- Paddle for payment processing
- Cal.com/Calendly for scheduling
- OpenAI & Anthropic for LLM services
Use of these services is subject to their respective terms and conditions.
9. Termination
We may terminate or suspend your account immediately for violations of these terms. You may cancel your subscription at any time, but refunds are not provided for partial months.
10. Limitation of Liability
To the maximum extent permitted by law, Ezier shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
